This is why it\u2019s important to hire a competent and experienced attorney in the field of estate planning.<\/p><p>Here are just a few common examples of what you can expect to find in an estate plan for your <em>personal<\/em> assets.<\/p><ul><li>Revocable living trust.<\/li><li>Pour-over will.<\/li><li>Living will.<\/li><li>Healthcare power of attorney.<\/li><li>Durable power of attorney.<\/li><\/ul><p>It doesn\u2019t end there! For example, if you have minor children, a declaration of preneed guardianship for each child is recommended. If you have a child or other family member with special needs that depends on you, then you might need a special needs trust in addition to the revocable living trust.<\/p><p>Concerning business assets, however, the plans vary wildly. There is notably less uniformity on the business side of estate planning. Nevertheless, here are a few common examples of different solutions you might find in an estate plan for your <em>business<\/em> assets.<\/p><ul><li>Buy\/Sell agreements.<\/li><li>Voting trust agreements.<\/li><li>Amended or restated bylaws, operating agreements, or partnership agreements.<\/li><li>One or more holding companies.<\/li><li>Retitling of certain assets.<\/li><\/ul><p>Like the personal side of things, this list can get much longer. There are land trusts, offshore trusts, subsidiary companies, holding companies, family LLCs or limited partnerships, privacy-focused entities, and a whole host of insurance products that play major roles in the overall business estate plan.<\/p><h3><strong>Who Needs Estate Planning?<\/strong><\/h3><p>If you have more than a dollar to your name, you need an estate plan. The more dollars you have, the more complex your estate plan is. For example, your estate plan might only need to consist of a will. In contrast, it might need to consist of a combination of offshore trusts, holding companies, and insurance products. It just depends on the assets you currently own.<\/p><p>It\u2019s not just about money. In fact, it\u2019s less about money and more about those around you! If you\u2019re married or have children, or both, you need an estate plan. If you have family members that depend on you for their medical or other needs, you need an estate plan. If you have employees, you need an estate plan. If you are self-employed, with or without employees, you need an estate plan.<\/p><p>Let me reiterate for the sake of clarity, if any of the above applies to you, YOU NEED AN ESTATE PLAN. I\u2019m not only an estate planning attorney, I\u2019m also a probate attorney. As a probate attorney, I can\u2019t stress enough the importance of an estate plan. Without one, the potential disaster that awaits those that you love and depend on you, upon your death, can\u2019t be exaggerated.<\/p><h3><strong>Do you need an estate planning attorney?<\/strong><\/h3><p>The short answer: YES.<\/p><p>Of course, I\u2019m an estate planning attorney, so why expect anything other than a resounding \u201cYES,\u201d right? Here me out\u2026<\/p><p>(Enter: \u201cthe long answer.\u201d)<\/p><p>First, you don\u2019t need an estate planning attorney to draft the documents needed to make your estate plan legally binding. You can go to a DIY website or buy one of those canned estate planning document bundles from your local office supply store. If you fill those out correctly, you\u2019re good to go. (That\u2019s a big \u201cif\u201d in most cases, by the way.)<\/p><p>Congratulations! You\u2019re done!<\/p><p>\u201cSo, I <em>don\u2019t <\/em>need a lawyer! I <em>can<\/em> do it myself!\u201d say you. Well, not so fast. There\u2019s more\u2026<\/p><p>You see, you\u2019re not paying a lawyer to prefill and print an off-the-shelf document. Rather, you\u2019re paying a lawyer for his assessment, for <em>designing<\/em> an estate plan that he\u2019s confident will meet your needs, accomplish your goals, and withstand both scrutiny and certain legal challenges. If it ends up that all you need is one will (which is rarely ever the case), great! But, who\u2019s better qualified to make that decision? Not so for me. See <em>what is \u201casset protection\u201d<\/em>, below. In certain circumstances, an estate plan may protect against certain lawsuits, but the primary objective of most estate plans is <em>not<\/em> to protect against lawsuits. See, <em>what is \u201cestate planning\u201d<\/em>, above.<\/p><h3><strong>What is \u201casset protection\u201d?<\/strong><\/h3><p>The term \u201casset protection\u201d is defined by some as any strategy that protects your assets against any outcome you are trying to avoid. That definition, to me, is so broad as to have no meaning at all.<\/p><p>Others define \u201casset protection\u201d more narrowly, more technically, as any strategy aimed at protecting you against civil money judgments.<\/p><p>For example, if an estate plan \u201cprotects\u201d your assets against the time and cost of probate, is that an \u201casset protection\u201d strategy? Based on the first definition, if one of the outcomes you are trying to avoid is the time and cost of probate, then yes. The same can\u2019t be said about the second definition.<\/p><h4><strong>Examples of asset protection.<\/strong><\/h4><p>Here are some examples that both camps can agree as to what constitutes \u201casset protection\u201d.<\/p><ul><li>You buy an income generating property and title it in the name of an LLC.<\/li><li>You open an LLC that is owned by an anonymous LLC (which you also own).<\/li><li>You own a holding company that wholly owns other legal entities.<\/li><li>You open a Swiss bank account and title it in an offshore irrevocable trust based out of the Cook Islands.<\/li><\/ul><p>I hope this helps you better understand what asset protection is and \u2013 by some definitions of the term \u2013 what it is <em>not<\/em>.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5a816280 elementor-position-left elementor-vertical-align-middle elementor-widget
